The Liberal government of Dalton McGuinty passed the Energy Consumer Protection Act. The Ontario Energy Board has also aired two radio ads warning consumers against signing energy contracts.
A number of reasons. The current government had their hands full repairing the mess left by the Harris government. In the big picture McGuinty had more pressing matters to worry about than fixed price contracts. Furthermore these companies are huges sources of employment for agents that go door-to-door and the current government probably doesn't want to shut these businesses down unless they are really unpopular. There is no reason the current government would take such drastic action knowing that board members of these very same companies are elected into the legislature. This would seem to suggest that the public is behind them. The truth is that fixed-price gas and hydro contracts have never been a real election issue and will not be unless the people are angry enough about them to do the research about which parties support or oppose them. Finally, the energy retailers themselves have given the Progressive Conservative Party huge donations and this will ensure that Tories will put up a huge fight in the legislature if any attempt were made to ban the business practice, so the current government probably did the a cost benefit analysis and decided to maintain the status quo.
